From 6th April 2008 submitting 1APP standard application forms has become the only legal way of submitting a planning application within England and use of existing forms has been discontinued.

Planning Portal LogoCarlisle City Council works in partnership with the Planning Portal to provide an online application service. The Council actively encourages the submission of planning applications electronically.

You can apply for planning permission through the Planning Portal, which will also let you:

  • Create a site location plan (compulsory for all applications)
  • Attach supporting documents (such as plans or photographs)
  • Pay the application fee online

Many planning and listed building applications must now be accompanied by a Design and Access Statement. Failure to submit a Design and Access Statement, where required, will mean that your application can not be registered. The following guidance explains this requirement.

Commenting on a Planning Application

Carlisle City Council has a duty to consult on applications and believes that it should contact occupiers of neighbouring properties affected by proposals to find out what they think. As part of the application process we want to get the views of all interested parties.

How do I find out about an application?

The city council publicises planning applications usually by writing to near neighbours of the site, who are invited to comment on the proposal.

Some applications are advertised in the Cumberland News and/or by a formal site notice displayed on or near the application site. Applications advertised in this way are those that:

  • affect a listed building;
  • affect a conservation area;
  • depart from the council's local plan;
  • affect a public right of way, or
  • have a substantial impact on an area.

A period of time (normally 21 days) is allowed from the date of publicity for comments to be made. However, all written comments received up until the decision is made will be considered.

What can I comment on?

All comments we receive about a planning application will be considered, but only planning issues can be taken into account. These include:

  • loss of light or privacy
  • overshadowing of your home
  • highway safety
  • traffic and parking issues
  • noise
  • amenity
  • wildlife
  • historic buildings
  • conservation
  • design
  • appearance of the development.

Issues which cannot be taken into account, include:

  • loss of view
  • effect on property values
  • private rights
  • boundary disputes
  • construction noise.

What happens when I comment on an application?

All written comments on an application will be acknowledged. The acknowledgement letter will tell you who is dealing with the application and who to contact if you have any questions.

Our online planning application register lets you:

  • search for details of planning applications from January 1992
  • search for current planning applications and track their progress
  • view the submitted plans and documents for recent applications. We aim to publish documents online within 5 days of the validation of an application.
  • comment on a current application and submit comments online 
  • view decisions made and any conditions or reasons attached
  • search for details of any appeals
  • see which applications were discussed at the most recent Committee
  • see which applications are scheduled for the next Committee meeting

Please note that when commenting on planning applications, your reply will be available for inspection by the applicant and the public both at the council offices and on the internet.

Plans, drawings and material submitted to the council are protected by the copyright acts (section 47, 1988 act). You may only use material which is downloaded and/or printed for consultation purposes, to compare current applications with previous schemes and to check whether developments have been completed in accordance with approved plans. Further copies must not be made without the prior permission of the copyright owner.

Delegated Powers

As with all Local Planning Authorities the City Council has a scheme of delegations which allows under certain circumstances decisions on planning applications to be determined by the Head of Planning Services.

Development Control Committee

The Development Control Committee meets every six weeks to consider the Schedule of Applications and other Reports.

Under Section 54A of the Town & Country Planning Act 1990, all planning applications have to be determined in accordance with the Development Plan (the Development Plan for Carlisle is the Cumbria and Lake District Joint Structure Plan and the Carlisle District Local Plan) unless material considerations indicate otherwise.

An officer Report to assist the Committee in determining the application accompanies all the applications that are considered by the Development Control Committee. The Report identifies the relevant development plan policies, supplementary planning guidance, other planning policy guidance issued by the Government, describes the proposal and planning history of the site, summarises consultations, objections and representations and makes a recommendation based on planning policy and other material planning conditions.

Some Reports may not contain a recommendation as further information is awaited and expected to be available for the Committee. In these cases the officer will make a verbal recommendation at the Committee.

The Development Control Committee may approve, refuse or defer consideration of the application for further information or a site visit.

The City Council operates a "Right To Speak" at the Development Control Committee for objectors of applications for Planning Permission, Listed Building Consent, Advertisement Consent, Conservation Area Consent and the making of Tree Preservation Orders.
