Neighbourhood Services - Environmental Privacy Statement

Carlisle City Council is committed to protecting and respecting your privacy in terms of how we collect, use, store and destroy your personal information.

We are the data controller of the personal information we will collect from you and under the General Data Protection Regulation, this fair processing notice is designed to provide you with all the information you have a right to be provided with.

Why are we collecting your personal information?

The local authority has a responsibility to carry out a range of statutory duties and public duties to keep the borough safe.  
 
When we collect and use your information for neighbourhood services we need this to:

  • Investigate offences or deliver a remedy under a range of Neighbourhood Services legislation and in line with the Council’s enforcement policy
  • Issue fixed penalty notices for environmental crimes and anti-social behaviour.
  • Investigate your request, contact you, or meet our statutory or authorised discretionary duties

What allows us to collect your personal information?

When we collect and use your personal information for Neighbourhood Services, we do so as part of our public duties as a local authority in order to keep the borough safe and healthy.  The legislation, policies and guidance that allow us to do this includes but is not limited to:

  • General Data Protection Legislation Article 6 part e
  • Environmental Protection Act 1990 and Environment Act 1995
  • Clean Neighbourhoods and Environment Act 2005
  • Anti-Social Behaviour Act 2003
  • Anti-Social Behaviour, Crime and Policing Act 2014
  • Animal Welfare Act 2006
  • The microchipping of dogs (England) regulations 2015
  • The unauthorised deposit of waste (fixed penalties) regulations 2016 

What personal information will we collect?

The information that we collect about you for neighbourhood services will include: •Information about you i.e. your complaint or offence, your name, address, postcode, telephone number(s), email address, picture or date of birth.

What will we do with your personal information?

The information that you give us may be shared with other local authorities’ enforcement agencies and legal services in accordance with Schedule 2 Part 1 (3) of the Data Protection Act 2018 for the purpose of crime and taxation. 
 
In cases where you have agreed to act as a witness in your name and address maybe disclosed as part of the court process and become public as a result. Additionally, if you are subject to prosecution action personal details will be made available to the court service and made public via that route

If you do not provide information as part of an investigation or as part of your service request we may be unable to investigate on your behalf, or keep you informed of progress made. Additionally, for many of our inspection duties, failing to provide information can be viewed as obstruction and you may be leaving yourself at risk of being prosecuted or fined. An officer will advise whether the information is essential or not in such cases 

How long will we keep your personal information?

Your personal information and the information held in relation to your request will be kept for 2 years in accordance with the Council’s Retention Schedule, at which point it will be securely destroyed.

  • To have inaccurate personal information rectified
  • To have personal information erased
  • To restrict processing of your personal information
  • To obtain and reuse your personal information for your own purpose
  • To object to the processing of your personal information
  • To not be subject to decisions based solely on automated means, including profiling
