Surveillance Camera Privacy Notice  

Carlisle City Council is committed to protecting and respecting your privacy in terms of how we collect, use, store and destroy your personal information. 
We are the data controller of the personal information we will collect from you and under the General Data Protection Regulation, this privacy notice is designed to provide you with all the information you have a right to be provided with. 

Why are we collecting your personal information? 

The Council collects CCTV images for public and staff safety and to deter and detect crime and disorder. Recordings also provide enforcement agencies with evidence of criminal activity, for formal actions including prosecutions in court and identification of offenders in investigations.    
On occasions where Regulation of Investigation Power Act (RIPA) applies, this may include targeted footage of private property. 
We operate CCTV in and around our Council offices. Where fixed CCTV cameras are operating, there will be signs clearly displayed. 

What allows us to collect your personal information? 

The lawful basis for using the information we collect is: 
• it is in our legitimate interest and for the interest of public safety, the prevention and detection of crime, apprehension and prosecution of offenders and for legal proceedings
• public task: the processing is necessary for us to perform a task in the public interest or for our official functions, and the task or function has a clear basis in law
• in some circumstances - Vital interests: the processing is necessary to protect someone’s life 
The legislation that allows us to do this includes, but is not limited to: 
  • Section 163 of the Criminal Justice and Public Order Act 1994
  • Crime and Disorder Act 1998
  • Protection of Freedoms Act 2012
  • In certain Circumstances - Regulation of Investigatory Powers Act 

What personal information will we collect? 

The personal information we will collect will include live and archived video images where individuals, including members of the public going about their daily business as well as offenders, persons wanted and missing, may be identified.  

What will we do with your personal information? 

We may share some information with other organisations including: 
  • CCTV operators
  • Internal/External enforcement agencies Trading Standards, HMRC.
  • Police Forces
  • Fire and Rescue Services
  • with members of the public under very strict Data Protection or Freedom of Information conditions
  • we will also share information with Insurance Companies, but only when compliant with Data Protection Legislation
  • we will share details of those convicted with local crime reduction partnerships.

How long will we keep your personal information? 

 
Live images from most Council CCTV systems are deleted after 28 days, unless there are exceptional reasons to hold the data for longer which are documented as part of the operating procedure. 
 

Your rights are:

  • To be informed
  • To access your personal information
  • To have inaccurate personal information rectified
  • To have personal information erased
  • To restrict processing of your personal information
  • To obtain and reuse your personal information for your own purpose
  • To object to the processing of your personal information
  • To not be subject to decisions based solely on automated means, including profiling
