Petition Scheme Privacy Notice

Carlisle City Council is committed to protecting and respecting your privacy in terms of how we collect, use, store and destroy your personal information.

We are the data controller of the personal information we will collect from you and under the General Data Protection Regulation, this privacy notice is designed to provide you with all the information you have a right to be provided with on why we need to collect your personal data and what we will do with it.

This privacy notice explains what personal information is collected, what it is used for and who it is provided to.  The notice also describes why we require your data, and the legal basis on which we do this.  This privacy notice relates to our Scheme for the Submission of Petitions, provides additional information relating specifically to this particular service, and should be read in conjunction with our Council Privacy Notice which provides more detail

Why are we collecting your personal information?

We use your information to verify the authenticity of and to process your petition and petition contribution; and to communicate with you regarding the petition which you have submitted and/or signed

What allows us to collect your personal information?

We collect and use your personal information only where it is necessary to do so in order to perform our public tasks or duties as a Local Authority.  The legislation, policies and guidance that allow us to do this includes, but is not limited to: 

  • General Data Protection Legislation
  • Local Government Act 2000
  • The Local Authorities (Referendums)(Petitions)(England) Regulations 2011
  • Council Procedure Rule 10.11 – Deputations and Petitions 

 What personal information will we collect?

Personal data consists of data from which a living individual may be identified. 
 
We hold information about individuals submitted when signing petitions under the Council’s Scheme for the Submission of Petitions.   This could include your name, address, postcode, telephone number, e-mail address and signature. 
 
While we will not ask for any other personal details, it may be the case that you include other personal details, including special categories of personal data, within your petition contribution. Any such information may also be processed and stored by us. 
 

What will we do with your personal information?

Your personal information will be processed internally by Council staff in accordance with the Council’s Scheme for the Submission of Petitions, and may be shared with other Council directorates / other Councils / relevant bodies with the purpose of responding to the petition.   If you do not provide your contact details we will be unable to provide you with a response.  If a petition is received with no contact details, then the Council reserves its right to stop working on the petition. 
 
Other than the lead petitioner’s name, personal information of signatories will not be published on any publicly accessible medium. Petitions will only reflect the total number of verified signatories for the petition in question. 
 
Petitions may be considered and debated at formal meetings of the Council or one of its Committees/Panels.  A copy of the petition may be made available for inspection by Councillors.   
 
The detail of your petition will form part of the public record held in perpetuity. 
 
We will not give information about you to anyone else, unless your consent has been given or the law allows, save in accordance with this Privacy Notice. 
 

How long will we keep your personal information?

All records are kept in compliance with Carlisle City Council’s retention schedule listed service by service. In brief, petitions are retained for 6 years after date created and securely destroyed

Your rights are:

  • To be informed
  • To access your personal information
  • To have inaccurate personal information rectified
  • To have personal information erased
  • To restrict processing of your personal information
  • To obtain and reuse your personal information for your own purpose
  • To object to the processing of your personal information
  • To not be subject to decisions based solely on automated means, including profiling
